Terms and conditions

Introduction

These General Terms and Conditions set out the conditions under which we enter into agreements with you and deliver the orders you have placed. In these General Terms and Conditions 'we/us/our' or 'Parfumado' refers to Parfumado B.V., a company registered in the Netherlands with the Chamber of Commerce, number: 68443048 and established at Joop Geesinkweg 201, 1114 AB, Amsterdam, the Netherlands. Please read these General Terms and Conditions carefully before you order a product via the Parfumado Shop or take out a Subscription with us. These General Terms and Conditions apply to all agreements, deliveries, orders, promotions and sampling campaigns that are carried out by or on behalf of us. Should you have any questions regarding these General Terms and Conditions, do not hesitate to contact Customer Happiness. Information about how we handle your personal data can be found in our Privacy Statement.

1. Definitions

  • Customer Happiness: Parfumado’s customer support team, reachable via email ( kontakt@parfumado.de), via the chat on our website, and/or via the telephone numbers indicated on our website.
  • Gift Card Subscription: Shall have the meaning in Clause 6.4.
  • Interested Party: Any person who has registered to receive the latest Parfumado news, updates and offers, and sampling campaigns.
  • Lock Moment: The date on which your perfume choice for the upcoming delivery is final. The specific date is displayed in your account on the Parfumado website.
  • Monthly Subscription: Shall have the meaning in Clause 6.2.
  • Order Acknowledgement: Shall have the meaning in Clause 4.3.
  • Order Confirmation: Shall have the meaning in Clause 4.4.
  • Parfumado Gift Card: A voucher issued by Parfumado. The Parfumado Gift Card is valid for 24 months from the date of issue by Parfumado. After that date, the Parfumado Gift Card can no longer be redeemed.
  • Parfumado Group: Parfumado together with its affiliated companies Rocket Campaigns B.V. and Parfumado Holding B.V.
  • Parfumado Shop: Parfumado’s online shop. 
  • Prepaid Subscription: Shall have the meaning in Clause 6.3.
  • Products: Products offered via the Parfumado Shop not being Subscriptions, such as full-size bottles of perfumes, travel cases in various colours, gift sets with multiple perfume vials, room sprays, and other related products and accessories.
  • Service Countries: The Netherlands, Belgium, Germany, the United Kingdom, Sweden and Denmark. Our service offering may vary per country.
  • Shipping Moment: The moment your order is sent out, usually seven (7) days after the Lock Moment. You will receive a shipping confirmation each month as soon as your order is on its way. 
  • Subscription: Is a service under which you receive a product of your choice from the Parfumado assortment each month during the Subscription Term, for a certain price payable either monthly or several months in advance.
  • Subscription Term: The term of your Monthly Subscription or Prepaid Subscription as specified in Clauses 6.2, 6.3. 

2. Information About Us
We sell decanted authentic perfumes in travel size vials and travel cases, as well as full size bottles of perfume and related products and accessories. The perfumes in travel size vials are repackaged by Parfumado.

3. Information About You

3.1 Our website is only intended for use by people residing in the Service Countries. We do not accept or process orders from persons located outside these countries.
3.2 By placing an order, you guarantee that you are authorised to enter into agreements, are at least 18 years old (or have obtained permission from your parents or guardians before entering into the agreement) and you reside in one of the Service Countries. 
3.3 You are responsible for providing and maintaining correct and current contact details, including at least a working email address and, if available, a telephone number. These details are necessary for communication regarding orders, Subscriptions, deliveries, payments, and other customer-related matters. If correct or current contact details are not provided, Parfumado is not liable for any consequences, such as missed communication about deliveries or payment reminders.

4. Conclusion of the Agreement

4.1 The offers made by Parfumado are not binding. By placing an order with Parfumado, you make a binding offer to conclude a contract of sale for a Product or Subscription.
4.2 The ordering process usually includes: 

      • For Product orders: Choice of a product, confirming the choice by clicking the button ‘add to cart’, verifying the choice in the bag or correcting it, clicking the button ‘checkout’, inserting the relevant data, selecting the method of delivery, selecting the method of payment and a binding submission of the order by clicking the button ‘pay now’. 
      • For Subscriptions: Registering on our website, choosing a Subscription option, verifying the choice and/or correcting it, inserting the relevant data, selecting the method of delivery, selecting the method of payment and a binding submission of the order by clicking the button ‘pay now’. 

4.3 After you place an order, we will automatically send you an email in which we confirm the receipt of your order (Order Acknowledgement). This Order Acknowledgement does not constitute the acceptance of your offer but is merely intended to inform you that we have received your order. It also includes detailed information in relation to your order and an order number, which you should state if you have any further questions about your order. If the products you want are not available, we will inform you of this promptly.
4.4
A contract of sale with you only comes into existence when we dispatch the first product of a Subscription / the Product ordered to you and confirm dispatch to you in the Order Confirmation.
4.5 We will not save the text of the agreement including these General Terms and Conditions after conclusion of the agreement. The text of the agreement is then no longer accessible to you.

5. Prices

5.1 Prices of the Subscriptions and the Products are based on the local currency of the respective Service Country and include VAT. If a surcharge applies on the price of the Subscription for a certain product, the surcharge amount will be clearly stated on the product page. Shipping is free, unless shipping costs are explicitly displayed in your order summary. 
5.2
We reserve the right to change Product prices and delivery charges at any time with future effect. Changes do not affect orders for which you have already received an Order Confirmation.
5.3 We reserve the right to change the prices of Monthly Subscriptions during the Subscription Term, about which you will be informed at least fourteen (14) days in advance. You will then have the option to terminate your Monthly Subscription within ten (10) days without being liable for any compensation to us. Any such price change will not take effect during your current Monthly Subscription month.
5.4 You must pay the prices specified in the agreement in accordance with the terms therein and the payment terms in Clause 10.

6. Subscriptions, Perfume Choice and Subscription Term

6.1 Perfume Choice: You can choose which perfume from our assortment you want to receive each month. You can submit your perfume choice until the Lock Moment. If you have not submitted a choice, you will automatically receive a perfume chosen by us.
6.2 Monthly Subscription: Is a Subscription entered into for an indefinite period of time.
6.3 Prepaid Subscription: Is a prepaid Subscription entered into for the subscription term specified in an order. After the term specified in the order, the Prepaid Subscription automatically converts into a Monthly Subscription unless terminated by either party in accordance with Clause 8.
6.4 Gift Card Subscription: Is entered into for a fixed number of months specified on the Parfumado Gift Card and automatically expires when the last month has passed.

7. Pausing Subscriptions

7.1 You can pause any Subscription for one (1), two (2) or a maximum of three (3) consecutive months. After the paused month or months, your Subscription will automatically be reactivated.
7.2 Pausing must be done at the latest on the day before your Lock Moment in your account settings. If you notify us after your Lock Moment that you wish to pause your Subscription, this will only take effect from the following month. No costs are charged for paused months. 

8. Termination

8.1 Monthly Subscription: Either you or Parfumado may terminate your Monthly Subscription any time by giving one (1) month’s notice, effective at the end of the then-current month of the Subscription Term. If you wish to terminate your Monthly Subscription, you must do so via your account settings on our website at the latest on the day before your Lock Moment.
8.2 Prepaid Subscription: Either you or Parfumado may terminate your Prepaid Subscription with effect at the end of the Subscription Term. If you wish to terminate your Prepaid Subscription, please contact Customer Happiness. If you do not terminate the Prepaid Subscription before the next Lock Moment after the end of the Subscription Term, your Subscription will automatically convert to a Monthly Subscription. If you notify us after your Lock Moment that you wish to terminate your Subscription, this will only take effect from the following month.
8.3 The Gift Card Subscription expires automatically and cannot be terminated with effect before the end of its term, see also Clause 6.4.
8.4 No costs are charged for termination.
8.5 We may terminate or dissolve agreements with you, if you act in breach of these General Terms and Conditions or, in our opinion, abuse promotions, offers or the services of Parfumado in a general sense, with immediate effect. We will inform you of this in writing. In case we terminate a Product order, if you have already paid for a Product, you will receive your money back within fourteen (14) days.
8.6 You can re-subscribe at any time after terminating a Subscription, but we reserve the right not to allow re-subscription if we have previously decided to terminate your Subscription.
8.7 Please note that terminating or pausing your Subscription does not mean that you will be removed as an Interested Party. The reason for this is to simplify any activations of a Subscription and to enable you to use other services we offer. If you wish to be removed as an Interested Party, you can contact Customer Happiness.

9. Returns

9.1 After taking out a Monthly Subscription or a Prepaid Subscription, you have a fourteen (14) day cooling-off period. You can terminate your Monthly Subscription or your Prepaid Subscription during this period by sending an email to Customer Happiness stating that you are invoking your right to return within the fourteen (14) day cooling-off period. If the Shipping Moment takes place during your cooling-off period, you must return the first month's package you received to us. Your first month’s package must be in its complete original condition, unused and undamaged. As soon as we have received it in good order, we will confirm the termination during the cooling-off period to you in writing.
9.2 After receiving a product from the Parfumado Shop, you have a fourteen (14) day cooling-off period. If you want to return your order, you must contact Customer Happiness. The product must be in its complete original condition, unopened, undamaged and, if applicable, also sealed. After you have received a confirmation of your return request from us, you must return the product within fourteen (14) days to:

9.3 Notwithstanding Clauses 9.1 and 9.2, no cooling-off period applies to personalised products. These products cannot be returned or exchanged for money. Parfumado Gift Cards can only be returned within the cooling-off period if they have not been redeemed and are not personalised (hardcopy).
9.4 The costs for return shipment are for your account. We recommend keeping a proof of shipment so you can demonstrate that you have sent your order to us.
9.5 As soon as we have received the returned product in good order, we will refund the full purchase amount to your account within fourteen (14) days, provided that the conditions for return as included in Clauses 9.1 (Subscriptions) and/or 9.2 (Products) have been met.
9.6 Your statutory right of withdrawal remains unaffected by any voluntary return option. If you are a consumer with your habitual residence in Germany, you can find further details regarding your statutory right of withdrawal are set out in our Withdrawal Notice, accessible here

10. Payment, Limitation of Right to Set-off and Retention

10.1 For payment, you can only use the payment options offered by us on our website, based on the applicable conditions for the relevant payment option. 
10.2 Monthly Subscription: Payment shall be made by authorising direct debit until the Subscription is terminated by you or us. The amount will be debited from your account on or shortly after the relevant Lock Moment.
10.3 Prepaid Subscription: Payment is made by paying the Subscription price for the relevant Subscription Term in one go in advance by using one of the payment options offered by us.
10.4 Gift Card Subscription: Payment takes place in the Parfumado Shop upon purchase of the Gift Card in accordance with the payment process in the Parfumado Shop and by using one of the payment options offered by us.
10.5 If a direct debit for the Monthly Subscription fails, you will receive an email from us with a request to still pay the amount due via a payment link within five (5) days. If the amount has not been paid after five (5) days, we will send a second payment reminder with a payment link to pay the amount within fifteen (15) days of receipt. As long as we have not received the payment, we may deactivate your Subscription until payment is received. If payment is not made, we reserve the right to charge collection costs. We will send you a third payment reminder with a payment link to pay the outstanding amount including statutory collection costs within eight (8) days of receipt. If the outstanding amount including collection costs is not paid within eight (8) days of receipt, we reserve the right to engage a collection agency.
10.6 The rules set out in Clause 10.5 regarding direct debit have been drawn up on the basis of the applicable national legislation. The applicable collection costs per Service Country can be found at: https://parfumado.com/en-NL/collection-fees.
10.7 You may only offset against any of our claims or assert a right of retention insofar as your claim has been legally established or is undisputed or acknowledged by us.

11. Promotions, Offers and Discount Codes

11.1 Promotions and offers are valid for the specified duration and as long as stocks last. Additional promotional conditions may be established per promotion or offer.
11.2 Discount codes can only be used on the basis of the applicable promotional conditions of the relevant discount code.
11.3 If you have entered into a Monthly Subscription, you can invite a friend to also order a Monthly Subscription using a friend discount code. Your friend can use this discount code to subscribe to a Monthly Subscription with a discount in accordance with the promotional conditions. Every time you invite a friend, you may choose one of the rewards visible in your account. These rewards become visible in your account when your friend has received an Order Confirmation. You will receive your reward together with your perfume at the next Shipping Moment.
11.4 You can use a maximum of one discount code per order. Combining discount codes and promotions is not possible. Only two (2) Subscriptions per household may be taken out per discount code.

12. Delivery

12.1 Delivery takes place as long as stocks last. If delivery is not possible, we will approach you with a proposal for a solution, such as an alternative product if you are a Subscriber.
12.2 Address: We deliver your order to the address you provided with the order. For Subscriptions, you can change your address until the Lock Moment. For orders for Products in the Parfumado Shop, once your order is ready for shipment and you have received the Order Confirmation, you can no longer change the address. If you discover that you have entered an incorrect address with your order, please contact Customer Happiness immediately.
12.3 Delivery of Subscriptions: We process the first month’s package of your Subscription at the time of the first Lock Moment after you have received the Order Confirmation. Delivery will usually take place within seven (7) working days after the Shipping Moment.
12.4 Delivery of Products: If you place an order on working days (Monday to Friday) before 13:00 in the Parfumado Shop, we will send your order to you the same day, unless otherwise stated on the product page. If you order on a working day after 13:00 or during the weekend, we aim to send your order on the next working day. The delivery period starts when you have fully completed the ordering process and have received the Order Confirmation from us. The Product will usually be delivered within three (3) to seven (7) working days after you received the Order Confirmation. 
12.5 The delivery times stated by us are indicative and, if exceeded, do not entitle you to dissolve the agreement or claim damages.
12.6 We are not liable for any delays by postal services beyond our reasonable control. If we are aware of significant internal or external delays, we will inform you of this in writing.
12.7 Should the stated delivery time be exceeded, please contact Customer Happiness as soon as possible and at the latest within thirty (30) days after the Order Confirmation, so that we can find out what went wrong and offer you a solution.
12.8
Around public holidays, the delivery time may be longer.
12.9 You shall bear all import taxes (if any) related to the delivery. 

13. Reviews

13.1 If you buy a Product in the Parfumado Shop or receive a product based on your Subscription, we may ask you to write a review about your experience. We will then ask you to choose a nickname, which may be published with the publication of the review. 
13.2 If you provide a review, your review must be accurate, sincere and truthful with pros and cons about (the functioning of) the product. Parfumado and our brand partners want your honest opinion to improve their product. We ask you to take the following conditions into account when writing your review:

      • contains understandable language and correct punctuation, capital letters, etc. 
      • is written in English or, if different, the local language of a Service Country 
      • is not intentionally offensive and contains no offensive, obscene, abusive, discriminatory, defamatory or otherwise misleading information 
      • contains no personal information such as email addresses & telephone numbers 
      • contains no advertising or information about prices or sales locations 
      • contains no questions or comments (for this you can contact Customer Happiness).

13.3 The review is a personally written, original piece by you that you have not copied from another source. Any spelling and/or grammatical errors are not always corrected before your review is published, although we and our brand partners do have the right to correct them. Our brand partners also have the right to make limited technical changes, to correct possibly incorrect, misleading or offensive information. The underlying opinion of your review will not be changed.
13.4
You may only submit one (1) review per product. You may also only submit a review for products that you have received. We collect your email and IP address when you submit a review so that we, together with third parties, can verify the authenticity of your review and protect against fake reviews, further information on our processing of your personal data can be found in our Privacy Statement.
13.5 You hereby give us permission to share your review and the information you provided with it. This information will be shared with our brand partners and third parties who help us collect, verify and share your review.
13.6 You hereby give us, brand partners and other applicable third parties permission to publish your review.
13.7 Circumstances may arise whereby we or our brand partners do not publish your review. Neither we nor our brand partners are obliged to publish a submitted review.

14. Samples

Within the Parfumado Group, in addition to our Subscriptions and Products, we also provide sampling campaigns for beauty and perfume brands. This means that you can claim free perfume and beauty samples or that you can receive a free sample with your order. After receiving a sample, you may be asked to complete a survey and/or write a review. If you have received a sample of a beauty product or perfume, you cannot derive any rights from it other than that it is an indication of the nature of the product.

15. Your Obligations, Liability

15.1 You may only use the products for what the products are intended for. All instructions on the packaging and leaflets must be followed. No liability is accepted for deviant use. 
15.2 We are liable exclusively and without limitation for damages you suffer insofar as that damage is caused by intent or gross negligence on our part, or where liability cannot be excluded under mandatory applicable law.
15.3 Subject to Clause 15.2, if it is established that we are liable for any damages, we are only liable for direct damage arising from or related to the execution of an agreement. Liability for indirect or consequential damage, including loss of profit, missed income, damage to goodwill or reputation, etc., is excluded.
15.4 In addition, subject always to Clause 15.2, our total liability is limited to a maximum of one hundred fifty percent (150%) of the total purchase price paid or payable for the relevant Product. In case of a Subscription, our liability is limited to the lower of (i) the total price paid or payable for the Subscription up to the time the damage occurred, or (ii) the price of a twelve-month Prepaid Subscription.

16. Complaints Procedure

16.1 Upon receipt, you should check the delivered product as soon as possible for any shortcomings, such as a leaking bottle, a defective travel case or spray, an incorrectly received perfume or a missing product. 
16.2 Complaints about such shortcomings, including missing products, should ideally be submitted to Customer Happiness as soon as possible or within thirty (30) days after receipt of your order, accompanied by photo or video evidence.
16.3 We will try to handle your complaint as soon as possible. If we expect that we cannot process your complaint within a week, you will in any case receive a confirmation of the complaint from us and we will let you know when we expect a substantive response. 

17. Intellectual Property

17.1 Texts, photos, our website, the Parfumado Shop, mailings and other materials developed by us or managed by us are protected by copyright, trademark law, design law or other intellectual property right. 
17.2 Your use may in no way reproduce, modify, copy, distribute or use the materials for commercial purposes. For your own use, you must adhere to all our intellectual property rights.
17.3 You hereby grant us the right to quote and share on our websites and social media, images and texts that you post on a website, blog or social media, in which our Subscriptions and Products are visible.

18. Amendments, Governing Law and Consumer Dispute Resolution

18.1 We may amend and/or update these General Terms and Conditions for existing Subscriptions from time to time with future effect and as necessary for technical, economic or legal reasons. We will notify you of any changes to these General Terms and Conditions as appropriate under the circumstances, by sending you an email no later than six (6) weeks before the proposed effective date. You may either approve or object to such changes before their proposed effective date. All changes shall be deemed approved by you, unless you object to the revision before the proposed effective date. 
18.2 We may amend these General Terms and Conditions for future Subscriptions or any orders for Products from time to time for any reason without notice.
18.3 Should any provision of these General Terms and Conditions become ineffective or invalid, it shall be replaced by a provision that comes as close as legally possible to what would have been agreed, pursuant to the meaning and purpose of the original provision and of these General Terms and Conditions if the ineffectiveness or invalidity of the original provision had been recognised. If this occurs, this does not affect the other provisions of these conditions.
18.4 Any disputes or claims (whether contractual or non-contractual) arising out of or in connection with the agreement including these General Terms and Conditions shall be governed by and construed in accordance with the laws of the Netherlands. Mandatory laws of the country of your habitual residence (i.e. the provisions of the law of that country which cannot be derogated from by agreement) shall remain unaffected. The United Nations Convention on Contracts for the International Sale of Products (CISG) shall not apply.
18.5 In the event of a dispute, the court in Amsterdam has jurisdiction.
18.6 We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
